- Use of Services
ATrade provides a digital marketplace platform for users to buy and sell goods. Users must register an account to list items for sale or to make purchases. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
- User Conduct
You agree not to use the Services to:
- Post, list, or upload content or items in inappropriate categories or areas on our sites;
- Breach or circumvent any laws, third-party rights, or our systems, policies, or determinations of your account status;
- Use our Services if you are not able to form legally binding contracts (for example, if you are under 18 years old), or are temporarily or indefinitely suspended from using our sites, services, applications, or tools;
- Fail to pay for items purchased by you, unless the seller has materially changed the item’s description after you bid, a clear typographical error is made, or you cannot authenticate the seller’s identity;
- Manipulate the price of any item or interfere with any other user’s listings;
- Post false, inaccurate, misleading, defamatory, or libelous content.
- Intellectual Property Rights
All content included on ATrade, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the site, is the property of ATrade or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights.
- Liability Limitation
ATrade shall not be liable for any lost profits or any special, incidental, or consequential damages arising out of or in connection with our site, our services, or these Terms (however arising, including negligence). Our liability to you or any third parties in any circumstance is limited to the greater of (a) the amount of fees you pay to us in the 12 months prior to the action giving rise to liability, and (b) N100,000.
- Dispute Resolution
Any dispute or claim relating in any way to your use of ATrade’s Services will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
- Modifications to the Services and Prices
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
- Termination
We may terminate your access to all or any part of the Services at any time, with or without cause, with or without notice, effective immediately.
- Governing Law
These Terms shall be governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions.
